These Terms & Conditions ("Terms”, "Agreement”) govern your access to and use of the website www.equipmentsdekho.com ("Platform”, "Website”) operated by Equipments Dekho ("Company”, "we”, "our”, or "us”). By using, accessing, or transacting on the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

1. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with applicable laws and regulations. You may not use the Platform in any way that may harm the Company, other users, or any third parties, including engaging in fraudulent activities, attempting to bypass the Platform’s communication systems, or misrepresenting your identity or business.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Listings, Content & User Responsibilities

Users may list construction equipment, browse listings, submit inquiries, and engage in communication with sellers or buyers. You agree that any information, documentation, descriptions, or media you upload to the Platform will be accurate, lawful, and free from infringement of third-party rights.

The Company reserves the right to review, modify, or remove any listing or content that violates our policies or is deemed misleading, inappropriate, or fraudulent.

3. Transactions Between Buyers and Sellers

Equipments Dekho is an aggregator platform. We facilitate the connection between buyers and sellers but do not own any of the equipment listed unless explicitly stated. All transactions must be completed through the Equipments Dekho platform. 

All agreements, payments, negotiations, delivery, documentation, warranties, and after-sales matters are strictly between the buyer and seller. The Company shall not be held liable for any disputes arising from such interactions.

4. Pricing, Fees & Payments

Certain services on the Platform may require payment, including but not limited to listing fees, promotional packages, or value-added services. All charges will be displayed transparently before purchase. By making a payment, you confirm that you are authorized to use the selected payment method.

5. Cancellation Policy (Same-Day Cancellations)

You may cancel your purchase of any paid service (such as listing upgrades, featured listings, or promotional packages) on the same day the purchase is made, provided the service has not yet been fully utilized or activated.

Requests received after the same calendar day of the transaction may not be eligible for cancellation, unless otherwise mandated by applicable consumer laws.

 6. Refund Policy (6–8 Day Processing)

If your cancellation request is approved, or if you are eligible for a refund for any other reason, the refund will be processed within 6 to 8 business days.
Refunds will be issued to the original payment method used during the transaction.

Processing timelines may vary depending on your bank, payment gateway, and other external factors beyond our control.

The Company is not responsible for delays caused by banks, payment processors, or unforeseen technical issues.

 7. Shipping & Delivery (1–7 Day Shipping Time)

For any products, documents, or physical items shipped by Equipments Dekho—including but not limited to promotional materials, physical documents, merchandise, or verification kits—the shipping timeline will typically range from 1 to 7 business days, depending on your location and courier service availability.

This section applies only if the Company is responsible for shipping physical items.
For equipment shipments, delivery, logistics, and timelines are the responsibility of the seller and buyer directly, as Equipments Dekho is not involved in the physical transportation of equipment.

 8. Intellectual Property

All intellectual property on the Platform—including logos, designs, graphics, text, software, branding elements, and proprietary content—is owned by Equipments Dekho or its licensors. Users may not copy, reproduce, modify, distribute, or commercially exploit any material without written consent.

 9. Prohibited Activities

Users must not engage in:

• Attempting to bypass the Platform by exchanging direct contact details
• Uploading false, misleading, or fraudulent listings
• Misusing the chat system to share inappropriate or unlawful content
• Harming the Platform through hacking, scraping, or unauthorized accesc
• Violating any applicable laws or regulation
• Contacting other users for non-platform-related solicitations or spam 

 10. Disclaimer of Liability

Equipments Dekho provides the Platform "as is” without warranties of any kind, express or implied. While we strive to ensure accuracy and security, we do not guarantee that the Platform will be error-free, uninterrupted, or free from harmful components.

We are not responsible for:

• The quality, accuracy, or condition of equipment listed
• Misrepresentations made by buyers or sellers
• Transaction failures, disputes, or losses between parties
• Delays or delivery issues caused by sellers, buyers, or logistics providers
• Actions taken by users outside the Platform

 11. Limitation of Liability

To the fullest extent permitted by law, Equipments Dekho shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, goodwill, business opportunities, or equipment damage.

 12. Termination of Access

We reserve the right to suspend or terminate your account at any time, without prior notice, if you violate these Terms, engage in fraudulent behavior, misuse our services, or pose a risk to the safety of other users or the Platform.

 13. Changes to These Terms

We may update or revise these Terms periodically. The updated version will be posted on this page with a new "Last Updated” date. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.
